A sum of $35 million has been made available under the Restaurant Return-to-Work Tax Credit Program in New York state to assist eligible restaurants that were affected by the pandemic.

Then program, administered by Empire State Development (ESD), will be available to partnerships, LLCs, C-corporations and S-corporations that have a valid federal employer identification number (FEIN) and to sole proprietors with a valid social security number. To qualify, the business must be independently owned and operated with fewer than 100 full time equivalent employees.

Eligible businesses must be located in New York City or in an area of the state that experienced an orange or red COVID-19 zone for at least 30 consecutive days. Outside of the City, these areas exist in regions of Chemung, Erie, Monroe, Onondaga, Orange, Rockland and Westchester Counties. Businesses that benefitted from federal programs, such as PPP or EIDL, or a state loan program, are still eligible for this tax credit.

According to ESD.NY.gov, restaurants “may claim the credit after August 31, 2021 (Fast Track Option), if the business can demonstrate a net employee increase of at least 1 full-time employee as measured from April 1, 2021 to August 31, 2021.”
